Phi Lan M. Tinsley

Phi Lan Tinsley focuses her practice on intellectual property counseling and litigation in matters related to trademarks and copyrights, unfair competition, false advertising; and internet and social media brand management. She has specialized knowledge of intellectual property licensing agreements, strategic brand adoption and protection, domain name acquisitions, marketing and promotional campaigns including key word advertising, sweepstakes and contest promotions.

Phi Lan regularly advises clients on all aspects of trademark prosecution, enforcement and maintenance of domestic and international trademark portfolios; she also has a strong background and knowledge of prosecuting non-traditional trademarks. Phi Lan assists both licensees and licensors negotiate and draft key licensing agreements and implement licensing programs, procedures and guidelines for clients operating across multi-jurisdictions. In addition, Phi Lan represents clients in Trademark Trial and Appeal Board proceedings; domain name disputes and in federal court.

Phi Lan also counsels clients on complex copyright matters, specifically the enforcement of an owner’s affirmative rights; the review and negotiation of publishing contracts and copyright assignment agreements. Phi Lan is well versed in the mechanics and issues that arise with registering copyrightable works including software, novels, films, music, video games and artwork; and addressing issues of copyright infringement and permissible use of copyrighted materials.

Phi Lan brings her expertise to clients in the textile, pharmaceutical, biotechnology, food, health care, publishing, software, telecommunications, marketing and research, art and entertainment industries. In addition, Phi Lan regularly provides pro bono legal advice through Volunteer Lawyers for the Arts and Springboard Enterprises, an organization providing support, capital and partnerships for high-growth technology-oriented companies led by women.

Prior to joining K&L Gates, Phi Lan was an associate in the patent and intellectual property group of Testa, Hurwitz & Thibeault, LLP.  Phi Lan is fluent in Vietnamese.
