Represented US based developers of LNG export facilities before the Federal Energy Regulatory Commission (FERC) and the Department of Energy (DOE) to obtain project authorizations and defend them in the US Court of Appeals. Provided regulatory and commercial counsel, monitored relevant FERC and DOE updates, and researched authorization timelines to help clients plan strategically and support the long-term export of LNG to global markets.
Drafted and negotiated numerous natural gas pipeline transportation agreements, including for large utilities supplying data center facilities. Representation also included providing counsel on the jurisdictional considerations for the siting of new lateral pipelines and facilities, conducting research into industry standards for clauses used in negotiated agreements, and summarizing contractual termination rights and obligations for existing contracts.
Drafted and filed interventions on behalf of clients seeking to intervene in FERC natural gas proceedings.
Represented a client seeking to use the equivalency and special permit processes at PHMSA to seek authorization for the use of new technology in the LNG export context.
Prepared and filed comments on behalf of an industry in response to federal agency rulemaking proceedings.
Advised a client on potential avenues for developing natural gas pipeline systems to meet the growing need for energy to power data centers.
Counseled a client on potential regulatory and policy considerations for the development of projects sited on federal land.
Prepared compliance training materials for a natural gas shipper covering legal obligations, best practices, and enforcement trends.
Refined a client’s existing pipeline integrity management plan and recommended additional safety measures.
Analyzed the viability of numerous commercial opportunities for an industrial client seeking to partner with existing and planned hydrogen projects to reduce operational emissions.

Power

Advised a client on the various state-level regulatory structures that would impact a co-location arrangement between a generator and data center. Representation included identifying favorable jurisdictions for co-location arrangements.
Represented a client in an electric rate case proceeding before the Texas Public Utility Commission. Representation included the review and preparation of expert testimony regarding the proposed allocation of cost increases among the various rate classes.
Advised a client on various regulatory considerations related to co-location and interconnection and the development of data centers.
Counseled a client on regulatory updates coming out of FERC regarding cost-allocation considerations.
Drafted comments on behalf of a battery storage client regarding the adoption of a demand response program in New Jersey and the potential impact on commercial and industrial uses for battery storage devices.
Assisted a client with drafting and filing annual renewable energy portfolio standards with the California Public Utilities Commissions.
Advised a client on the federal regulations to set an avoided cost rate under the Public Utilities Holding Company Act of 1978.
