Erik J. Halverson

Erik Halverson conducts complex patent disputes for technology and consumer-facing companies, coordinating district court litigation, PTAB proceedings, ITC investigations, and Federal Circuit appeals.  Erik translates complicated technologies and legal issues into focused strategies that protect critical products, manage litigation risk, and advance broader business objectives. A first-chair trial lawyer and registered patent attorney with a degree in engineering physics, Erik brings both courtroom experience and technical fluency to matters involving sophisticated products and global patent portfolios.

Clients engage Erik to:

  • Lead high-stakes patent cases involving critical products, complex technologies, substantial damages claims, and potential injunctive relief.
  • Coordinate district court litigation with IPR, PGR, and ex parte reexamination proceedings before the USPTO.
  • Handle patent disputes through trial, ITC investigation, post-grant review, and Federal Circuit appeal.
  • Advise on licensing, settlement, product clearance, due diligence, and domestic and international portfolio strategy.

Erik’s representative experience includes:

  • Led a trial team in a patent jury trial involving digital projection technology. 
  • Defended an asserted patent portfolio against 42 inter partes review petitions, defeating institution in 28 proceedings. 
  • Coordinated district court and PTAB proceedings for a multi-national healthcare company and defeated institution of every related IPR challenge and multiple reexamination requests. 
  • Successfully overturned the PTAB at the Federal Circuit in a precedential decision for a global technology company. 
  • Presented and cross-examined technical witnesses in an ITC investigation involving semiconductor technology. 
  • Coordinated US and European validity proceedings as part of a cross-border patent strategy. 
  • Negotiated domestic and international patent settlement and licensing agreements.

Erik is experienced in all facets of patent litigation from initial motions through post-verdict briefing and appeal. He has been involved in cases in the Northern and Southern Districts of California, the District of Delaware, the Eastern and Western Districts of Texas, the Southern District of Mississippi, and the Eastern District of Virginia, among other jurisdictions across the country. His jury trial experience includes conducting opening statements, the presentation of and cross-examination of technical and damages witnesses in federal district court. Erik also has experience presenting and cross-examining witnesses before the International Trade Commission (ITC). At the Federal Circuit, Erik has secured favorable outcomes for his clients by focusing on the issues that matter most and approaching those issues from all angles.

As a PTO-registered lawyer, Erik has served as primary counsel in more than 150 IPR and PGR matters, representing both petitioners and patent owners from initial strategy through oral argument and appeal. He regularly integrates post-grant proceedings and reexaminations with parallel district court litigation. Erik helped expand the firm’s ex parte reexamination practice in 2025, overseeing the filing of over 40 reexamination requests.

Erik has experience handling standard patent prosecution matters as well as arguing prosecution appeal matters before the PTAB. Erik also handles patent licensing, due diligence, and counseling matters. His experience includes license negotiation and drafting; joint development agreements and independent contractor agreements; and international IP portfolio review.
