Berto Aguayo is an associate in the firm’s IP Procurement and Portfolio Management practice group and a member of the Data Protection, Privacy and Security practice group.
His practice focuses on trademark clearance, prosecution, enforcement, and portfolio management, as well as data protection, privacy, and technology-related regulatory compliance matters. Berto works with clients across a range of industries, including fashion, software, technology, food and beverage, manufacturing, and startups.
Berto supports the management of clients’ US and global trademark portfolios, including clearance, filing strategy, prosecution, and post-registration maintenance. His experience includes assisting with US and foreign trademark clearance searches, preparing and prosecuting US trademark applications, responding to substantive and procedural Office Actions, and supporting enforcement efforts such as cease-and-desist letters, online takedowns, and watch matters. He also assists with trademark opposition matters and coordinates with foreign counsel on international trademark and enforcement issues.
As part of the firm’s Data Protection, Privacy and Security practice group, Berto supports clients on privacy and data protection matters, including reviewing and negotiating data processing agreements and software licensing agreements, and assisting with regulatory compliance and risk management under frameworks such as the California Consumer Privacy Act, Federal Trade Commission requirements, and the General Data Protection Regulation. He also supports intellectual property and data protection due diligence in mergers and acquisitions.
