Represented investor and secured lender in tech start up company in enforcing secured creditor rights, including instituting and pursuing a sale under Article 9 of the UCC and working to obtain dismissal of intervening bankruptcy case.
Represented multinational bank as bankruptcy counsel in relation to secured claim in a Chapter 7 bankruptcy case, including preparing and filing proofs of claim and coordinating with Chapter 7 trustee with respect to liquidation of collateral and share of proceeds of the same.
Prepared and filed proofs of claim and voting on plans of reorganization for institutional investment manager.
Negotiated the complete withdrawal of complaint asserting damages for purported preferential transfer.
Assisted in administration of bankruptcy case for world's largest private sector coal company, including obtaining plan confirmation, developing a plan to resolve overriding royalty obligations, and objecting to proofs of claim, resulting in the reorganization of over US$8 billion in liabilities.
Assisted in administration of bankruptcy case for coal company, including preparing solicitation and contract procedures related to the plan of reorganization, resulting in over US$800 million in asset sales.
Represented a regulated utility company as parent of a bankrupt subsidiary, including advising parent of rights and risks related to subsidiary's filing, coordinating discovery with respect to potential litigation matters related to the same, and developing strategy for decoupling integrated technology sharing arrangements between the two.
Assisted in preparing and filing Chapter 11 case on behalf of small airline that provided charter flights.
Represented creditor in connection with a contract counterparty's assignment for the benefit of creditors, including preparing and filing a claim in the same.
Represented the assignee in an assignment for the benefit of creditors case relating to a hotel management business, including preparing assignment documents, coordinating filing and statutory compliance, and resolving various matters related to claims.
Represented assignor in assignment for the benefit of creditors with respect to executing sale documents of intellectual property rights prior to commencing an ABC and initiating the ABC process thereafter.
Assisted in limiting effectiveness of Indonesian PKPU plan's effectiveness in the United States as part of Chapter 15 process.
Served as local real estate and litigation counsel with respect to real property development, which parties abandoned.
