Successfully represented Abercrombie & Fitch Trading Co. through trial at the US Trademark Trial and Appeal Board in the enforcement of their HOLLISTER bird design mark. Secured final judgment sustaining the opposition in favour of Abercrombie, with the board finding in Abercrombie’s favor as to likelihood of confusion. Applicant in the above-referenced TTAB Opposition Proceeding has appealed the TTAB’s final judgment to the District Court in the Northern District of Ohio. We are currently representing Abercrombie & Fitch in that District Court appeal.
Represents one of the world’s largest fragrance companies as trademark counsel before the USPTO, the TTAB, and in related enforcement matters. Obtained several favorable judgments against third-party applications for marks covering certain Class 3 and related goods before the TTAB.
Act as US trademark enforcement counsel to manufacturer, distributor, and retailer of award-winning, premium quality skin, hair, and nail products.
Represents American media publication based in Washington, D.C. that covers daily government business for civilians, federal bureaucrats, and military officials in trademark prosecution and enforcement matters. Successfully defended client in trademark enforcement matter prior to any formal action by adversary. Successfully represented the same client in enforcement of its copyright rights, API, and the overall look and feel of its proprietary website database.
Regularly counsel major marketing automation and email marketing platform on advertising and website copy issues, including with respect to client’s plan pricing options.
Act as advertising counsel to children's organic food manufacturer. Regularly advise client on baby and toddler food product claims and related substantiation, a heavily regulated space.
US trademark counsel for iconic nonprofit organization dedicated to eliminating racism and empowering women. Partnered with client to implement strategic business plan to formalize all intellectual property rights with its licensees and recommended new trademark filings—more than tripling the client’s rights to ensure more control and accountability. Represented client in application to register its color mark at the USPTO.
Represented a leading, global specialty retailer in bringing trademark infringement lawsuit against two global clothing brands relating to their use of a moose design on clothing. Able to leverage global enforcement actions in the United States, Canada, United Kingdom, and European Union, resulting in favorable resolution for our client.
Represented a sugar-free breakfast and snack foods manufacturer in trademark infringement and unfair competition litigation against a competing food manufacturer, resulting in favorable settlement prior to defendant’s answer deadline.
Represented a children's organic snack manufacturer in successfully obtaining a very favorable decision before the National Advertising Division.
