Advised Image Metrics, a world leader in facial analysis and detection software, on complex software licensing and software development kit issues relating to the Makeup Genius virtual reality technology, as well as a strategic license agreement with L’Oréal.
Advised Renzo Piano Building Workshop on its intellectual property licensing and protection programs for various international projects, including the Whitney Museum of American Art, the Shard, the Academy Museum of Motion Pictures, Centre Pompidou, Centro Botìn, the Paris Courthouse, and the Pathé Paris Cineplex.
Advised Fabergé‚ (UK) Ltd., a jewelry firm, on a trademark dispute.
Represented Alexander McQueen when filing a trademark application for McQueen, which was opposed by Metropolitan Services Ltd, the owner of the Christine McQueen trademark.
Advised Mon Purse Pty Ltd, a designer and manufacturer of handbags and leather goods, in relation to capital raisings and corporate law.
Advised Sanctuary Clothing LLC, a Los Angeles-based women’s fashion designer, on a buyout of Camuto Group, a 50% owner of the company.
Represented Seafolly, Australia’s most-recognized swimwear and women’s beachwear fashion brand, in copyright infringement proceedings that have been issued in Australia, Canada, and France, as well as advising on brand protection.
Advised Teadora, Inc. in connection with a convertible note financing round with angel investors. Teadora provides eco-chic, natural, vegan, and cruelty-free skincare products that are crafted with Brazilian Amazon rainforest superfruits.
Advised Furla on international brand, design protection and infringement, promotions, website, social media platforms, and retail stores.
Advised Natural Machines, Inc., a new-generation kitchen appliance company that combines technology, food, art, and design, on its Series A-1 Preferred Stock Offering fully subscribed by Hon Hai Precision Industry, Co. Ltd.
Advised Helly Hansen, a Norwegian producer of textiles and gear for sports and outdoor, on its worldwide intellectual property rights, including its trademark, patent, and enforcement matters.
Advised Ellestone Apparel LLP on its acquisition of a controlling stake in Monitane Holdings Limited, the parent company of the Fielding Group, a manufacturer and distributor of branded and own-label clothing supplying some of the United Kingdom’s leading retailers, including Tesco, John Lewis, Asda, and Marks & Spencer.
Advised Polartec on their trademark and copyright portfolios. Managed their clearance, prosecution, and enforcement work, including anti-counterfeiting counseling. Managed Polartec’s trademark licensing program, which includes thousands of licensees around the world.
Advised Alphaeon Corporation, a distributor of beauty, wellness, and lifestyle products and a subsidiary of private equity firm Strathspey Crown Holdings LLC (SCH), in its private placement of shares of Series A Preferred Stock. Led by Longitude Capital Management Co., LLC, the deal also included options to acquire shares of Alphaeon Class A Common Stock from SCH.
Advised Prada, Salvatore Ferragamo, OTB/Diesel/Maison Margiela/Marni, Giorgio Armani, Ermenegildo Zegna, Canali, Camera Nazionale della Moda Italiana, and Fédération de la Haute Couture et de la Mode on global distribution strategy and antitrust compliance.
Represented Neiman Marcus in a false discount pricing class action. The case was dismissed by the district court, reversed by the 9th Circuit, and ultimately settled favorably.
Represented Tango Hotel, a joint venture between the Cattan family group, Hilfiger family, Al Baseer Holly “Artist of Sight,” Rich Hilfiger “Artist of Sound,” and Stevie Williams “Artist of Motion,” in connection with various collaborations with contemporary artists such as Jersey Joe “Rime,” Sean Sullivan “Layer Cake,” Kevin Loung “YK Slanty,” Dave East, and Travis Scott.
Represented Onia in its swimwear collaboration with WeWoreWhat. This collaboration set the 2019 record for highest social media product launch and did US$2 million in direct to consumer sales via the platform on day one.
Represented Streetwear Apparel Group, LLC, Le Tigre, a joint venture between Vault Sportswear and Moes Wear, in connection with the licensing of the Le Tigre marks for the women’s collections.
Represented Pacific Bioscience Laboratories (Clarisonic) in its sale to L’Oréal.
Advised Zulily on trademark and copyright counseling and managing their global portfolio of Zulily-related marks. Represented Zulily, in addition to clearance and prosecution work, in both offensive and defensive disputes relating to trademarks and counseled the company regarding fair use.
Represented Thomas Pink as global intellectual property counsel, including managing the company’s entire global intellectual property portfolio of trademarks and designs; advising on enforcement, litigation, and licensing issues; and being primary outside counsel on marketing and advertising issues, e-commerce, contracts, collaborations, and other day-to-day legal matters. Advised by lawyers across the firm’s global platform in London, Paris, Chicago, Melbourne, Sydney, Hong Kong, Singapore, Beijing, and Taiwan.
Advised Coty on numerous international licensing, collaboration, digital, product launch, and mergers and acquisitions projects.
Advised LH Rubinacci, Italian luxury brand, (high-quality tailors, with shops in Milan, Rome, Naples, New York, and Tokyo) in relation to the renewal of the lease of their London shop at 96 Mount Street from Grosvenor Estates.
Represented Magi Enterprises (Kookai) in a range of intellectual property protection and enforcement matters, including a federal court litigation regarding a claim of infringement of a registered design. Advised Magi Enterprises globally on the Kookai trademark portfolio.
Advised China Dongxiang (Group) Co., Ltd (SEHK: 3818), a leading international sportswear-brand enterprise based in China, as an investor in a consortium that bought the Point Roberts Resort Marina, located at Point Roberts, Washington, just south of Vancouver, British Columbia.
