K&L Gates Contributes EU Chapter to American Bar Association's International Publication on Sustainability and Antitrust
In June 2023, the European Commission adopted long-awaited revised guidelines on horizontal cooperation between competitors, including a brand new chapter dedicated to sustainability agreements. The new guidelines clarify how EU competition rules apply to sustainability agreements, addressing long- standing uncertainties about whether and how competitors can collaborate in the European Union to achieve sustainability objectives without infringing the antitrust rules. The guidelines present significant opportunities for industry players to jointly tackle major sustainability challenges which are not feasible to overcome at all, or as quickly or affordably, acting alone.
