K&L Gates Contributes EU Chapter to American Bar Association's International Publication on Sustainability and Antitrust

Date: 20 June 2025
EU Policy and Regulatory Alert

In June 2023, the European Commission adopted long-awaited revised guidelines on horizontal cooperation between competitors, including a brand new chapter dedicated to sustainability agreements. The new guidelines clarify how EU competition rules apply to sustainability agreements, addressing long- standing uncertainties about whether and how competitors can collaborate in the European Union to achieve sustainability objectives without infringing the antitrust rules. The guidelines present significant opportunities for industry players to jointly tackle major sustainability challenges which are not feasible to overcome at all, or as quickly or affordably, acting alone.

Our EU Antitrust, Competition, and Trade Regulation practice group was pleased to contribute the EU chapter of the American Bar Association and International Antitrust Law Committee’s groundbreaking global publication Perspectives on International Antitrust: Sustainability and Antitrust, featuring articles from 20 different jurisdictions on this timely and complex topic.

K&L Gates’ chapter, co-authored by a team led by London partner Gabriela da Costa, including senior associate Niall J. Lavery, associate Aurelija GrubytÄ—, Brussels partner Nikolaos Peristerakis, and Berlin partner Dr. Annette Mutschler-Siebert, examines the key features of the EU regime and practical considerations for international businesses, can be downloaded here.
