Keith J. McCarthy

Keith McCarthy is an associate and a member of the Financial Institutions and Services Litigation practice group. He focuses his practice on bankruptcy, real estate litigation, as well as business and consumer financial services litigation.

Prior to joining the firm, Keith served as an associate attorney at a US law firm where he represented banks, investors, creditors, and mortgage servicers in federal and state courts. He also provided guidance and analysis for clients at all stages of chapter 7, 11, and 13 bankruptcy cases.

Keith frequently handles disputes over a bankruptcy plan’s confirmation, a property’s valuation, the use of cash collateral, proof of claim disagreements, allegations of violating the automatic stay, allegations of discharge injunction violations, or issues arising from a payment change notice. Keith routinely handles relief from stay motions and requests for in rem relief. Keith also assists with pre-suit negotiations, court-sponsored loss mitigation, and out-of-court workouts.

Keith regularly represents mortgage lenders, mortgage loan servicers, local and national banks in lawsuits involving breach of contract, state and federal laws related to lending, mortgage origination, loan servicing, debt collection, evictions, and unfair and deceptive trade practices. Keith also handles housing and building code enforcement issues, tax sales, and title issues.

A portion of Keith’s practice is also dedicated to working collaboratively with clients to resolve business disputes, indemnification issues, and insurance coverage disagreements.  

In an effort to honor Massachusetts veterans and their service, Keith is proud to work the veterans in offering legal aid in evictions matters.
