Patent Office Litigation - What You Need to Know

KL Gates Hosted Event
Date: 7 October 2015

The America Invents Act of 2011 created several new procedures for challenging the validity of patents at the Patent Office. These procedures -- Inter Partes Review (IPR), Covered Business Method Patent Review (CBM), and Post-Grant Review (PGR) -- have thus far been popular and effective in invalidating patents, and the body of Patent Office decisions so far provides valuable guidance and insights.

The 1.5 hour seminar included a discussion regarding:

  • The ins-and-outs of the new procedures, including what has proven to be effective,
  • The recent court decisions that review the Patent Office trials,
  • The still-lingering questions about the procedures, and
  • Considerations for both instituting one of these procedures and defending your patent against one
