The FCPA prohibits the payment of bribes to foreign officials to assist in obtaining or retaining business. The FCPA has an extensive reach and can apply to prohibited conduct that occurs anywhere in the world. U.S. public companies and their officers, directors, employees, and agents are the statute’s main focus, but foreign entities with a nexus to, or presence in, the United States may also be at risk.
David discusses developments in corporate enforcement policies, guidance on compliance programs, and offers insights on how the Biden Administration's prioritization of anti-corruption initiatives will affect enforcement by the Department of Justice.
