Remote work is not new, but the pandemic dramatically accelerated the necessity and implementation of remote and virtual collaboration. The urgency to adopt new technologies and ways of working remotely did not allow employers adequate time to explore the potential implications of a myriad of laws and regulations on their businesses and the accompanying risks created by managing their workforces in these new ways.

In the third webinar of our four part CLE series, our e-Discovery and Analysis Technology lawyers will discuss:

  • The importance of identifying new technologies adopted to support remote work both official and unofficial.
  • Assessing value in new technologies and understanding governance implications.
  • Incorporating new technologies into information governance policies and procedures, e.g.
    • Does your company's information governance policy account for the creation of new data types offered by collaboration software, including things like meeting recordings and transcripts? 1:group and 1:1 chats? virtual whiteboards?
    • Does it adequately cover data that employees create while working away from the office, such as on personal devices?
  • Preparing to account for newly adopted technologies in litigation, e.g.:
    • In the event of litigation, does your organization have a plan for identifying potentially relevant collaboration data?
    • Do you know where it is stored?
    • How you will collect, review, and produce it?
