The European Banking Authority Shadow Banking Guidelines: Unintended Consequences
This article considers the recent European Banking Authority Shadow Banking Guidelines (the “Guidelines”), seeks a definition of shadow banking and discusses some of the potential consequences of the Guidelines for traditional banks and the shadow banking sector. It also reviews some of the other tools that may be employed to provide regulatory oversight to shadow banks and to provide consumers with proper risk information.
