Derek McKee is an associate in the firm’s Labor, Employment, and Workplace Safety practice. Derek guides clients through a wide range of employment law issues, including discrimination, harassment, retaliation, wage and hour compliance, and restrictive covenants. He has developed particular niche expertise in wage and hour litigation and in the drafting and enforcement of restrictive covenant agreements. He regularly represents clients in the healthcare, hospitality, technology, financial services, and retail industries in court and arbitration. Derek has succesffuly handled litigation under Title VII, ADA, ADEA, FMLA, FLSA, Texas Labor Code, and other state-specific employment laws.
Derek has a proven record of securing early, cost-effective results for clients, including obtaining summary judgment dismissals that he subsequently ensured that were affirmed on appeal. In another example, he recently defeated certification of a nationwide FLSA collective in the 7th Circuit for a large healthcare company.
Derek also helps clients navigate the ever-changing landscape of federal, state, and local employment laws through client counseling, employment practices audits, policy reviews, M&A deal diligence, investigations, and drafting a variety of agreements to mitigate current and future risk for employers. Derek’s experience with all of the above recently enabled him to become one of approximately 642 lawyers in the State of Texas who are Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization.
