Our panel addresses immigration and employment law developments concerning the employment of foreign national researchers from China and other sensitive countries. We cover how to (i) phrase pre-hire screening questions to try to identify candidates that might be deemed "export concerns" before hiring, (ii) terminate an employment relationship due to an export compliance issue, (iii) navigate immigration strategies and considerations associated with such employment, and (iv) navigate the pre- and post-hiring relationship with candidates (or employees) who pose actual or perceived national security risks.
