Jian Jiang-Hernandez, Ph.D.

Jian’s practice focuses on intellectual property law, with particular depth in patent strategy, portfolio development, and technology-driven transactions. She provides strategic counsel to startups, research institutions, and multinational corporations on global patent planning, IP due diligence, licensing, and cross-border transactions. With a strong technical background and global perspective, Jian offers end-to-end intellectual property support—helping clients protect and commercialize innovations across diverse industries.

Drawing on her Ph.D. in materials science and years of research and legal experience, Jian brings deep technical and strategic insight to her work. Her experience spans a wide range of technologies, including electrical and electronic systems, semiconductors, software, telecommunications, biotechnology, life sciences, mechanical devices, medical technologies, advanced materials, and food technology. She also routinely handles patentability, non-infringement, and freedom-to-operate analyses, and has significant experience prosecuting and advising on international patent applications in key jurisdictions such as Japan, Korea, China, Europe, and beyond. 

In addition to her technical patent work, Jian regularly advises on intellectual property in business transactions. She conducts intellectual property due diligence in mergers, acquisitions, and licensing deals; evaluates and negotiates IP terms in joint ventures and strategic collaborations; and helps clients manage IP risk and optimize the value of their intangible assets across jurisdictions.

  • Food and Beverage: Jian has a robust track record of working with clients in the food and beverage sector, helping them protect innovations in functional ingredients, novel formulations, food processing technologies, and sustainable packaging solutions. She understands the fast-paced and competitive nature of the industry and works closely with clients to safeguard technologies that drive product differentiation and brand loyalty. Whether developing new health-focused formulations or addressing challenges in sustainable packaging, Jian tailors patent strategies to meet market demands and align with evolving consumer preferences. Her technical insight and familiarity with regulatory landscapes allow her to provide clients with comprehensive IP counsel that supports long-term business growth.
  • Battery Technologies: Jian has extensive experience working with clients in the battery technology sector, including innovations in lithium-ion, solid-state, and next-generation chemistries. Her work spans innovations in battery management systems, electrode designs, and energy storage platforms. With the energy storage industry rapidly advancing, Jian helps clients protect core technologies, navigate complex IP landscapes, and position their innovations for commercialization in both consumer and industrial applications. She is committed to securing robust patent portfolios that support long-term development and competitive advantage.
  • Energy and Sustainability: Jian also advises clients in clean technologies and sustainability sectors, including innovations in carbon capture, emissions control, green materials, and other ESG-aligned solutions. She works with companies focused on addressing global environmental challenges and ensures that their innovations are protected through strategic IP portfolios. Her work in energy storage also intersects with sustainability, where she assists clients developing next-generation solutions to reduce environmental impact.
  • Medical Devices and Life Sciences: Jian has worked on a range of medical technologies, including diagnostic tools, drug delivery systems, surgical devices, and implantables. She brings deep insight into the intersection of innovation, IP, and regulatory requirements in the medtech industry, ensuring clients’ technologies are well-protected while advancing through clinical trials and regulatory approvals. In pharmaceuticals, Jian has advised clients on biologics, antibody-drug conjugates (ADCs), and related technologies, including patents covering compositions, formulations, manufacturing methods, and companion diagnostics, as well as lifecycle management strategies.

Jian’s holistic approach to intellectual property combines deep technical knowledge with strategic foresight, helping clients leverage their innovations and navigate the global IP landscape with confidence. 

Prior to her legal career, Jian received her Ph.D. in Applied and Materials Science from the University of North Carolina at Chapel Hill. Her doctoral research focused on the detection and quantification of signature peptides from biomarkers for infectious diseases or cancers using MALDI (MS and MS/MS). She also developed and optimized a peptide chip method for diagnosing human diseases, researched the detection and quantification of EGFR in human tumors and Francisella tularensis in animal samples, tested and optimized immunoaffinity columns, researched cancer pathology in human cells using quantitative PCR, and explored the synthesis of a new polymeric drug delivery system for siRNA delivery in gene therapy. 

Before pursuing her Ph.D. in the United States, Jian earned her B.S. in polymer materials and engineering from Fudan University in Shanghai, China. She is fluent in Cantonese, Shanghainese, and Mandarin.
