Borrowers under the Paycheck Protection Program (PPP) are wrestling with recent Treasury and SBA guidance regarding eligibility for PPP loans and how proceeds can be used. Secretary Mnuchin has threatened "severe consequences" for borrowers who improperly receive or use a PPP loan. SBA and Treasury have created a "limited safe harbor" for borrowers who repay their loans in full by 14 May 2020.
